Judge: Dirty Bomb Suspect Can Meet With Lawyers

WASHINGTON -- A federal judge Tuesday cleared the way for a man accused of plotting to detonate a radiological dirty bomb in the United States to meet with his lawyers for the first time.

In a written ruling, the judge in Manhattan said he had considered and turned down the government's plea to reverse his December decision, in which he said Jose Padilla could have access to counsel.

Padilla, sometimes known by his adopted Muslim name, Abdullah Al Muhajir, couldn't see a lawyer while the judge was reconsidering the ruling.


Lawyers for Padilla, a U.S. citizen, had argued the government is wrongly detaining him as an enemy fighter, severely limiting his rights.

Federal prosecutors had no comment yet. A lawyer trying to meet with Padilla said the judge's ruling is "comforting" for all U.S. citizens.

Padilla was arrested in May at Chicago's O'Hare International Airport after a trip to Pakistan.

The government charges that Padilla approached Abu Zubaydah, al-Qaida's top terrorism coordinator who now is in U.S. custody, in Afghanistan in 2001 and proposed stealing radioactive material to detonate a dirty bomb in the United States.

The government has said he twice met with senior al-Qaida operatives in Pakistan in March 2001 and discussed the dirty-bomb plot.
