Padilla pleads not guilty to U.S. terror charges

MIAMI, Jan 12 (Reuters) - Jose Padilla, held for 3 1/2 years in a military brig without charges as an "enemy combatant," pleaded not guilty to terrorism charges in a criminal court on Thursday and was ordered held without bond.

Padilla, a former Chicago gang member and a convert to Islam, is accused with four other men of conspiring to murder and running a support cell that provided money and recruits for overseas terrorists.

Padilla, who the Bush administration alleged was plotting to set off a radioactive "dirty bomb" in the United States, was held by the military after his May 2002 arrest in a case that prompted rights groups and lawmakers to question President George W. Bush's authority to detain U.S. citizens.

A U.S. Supreme Court ruling cleared the way for Padilla, 35, to be transferred to federal authorities in Florida and he was brought to Miami a week ago under heavy security.

U.S. Magistrate Barry Garber on Thursday denied Padilla bond on the grounds he was a risk to flee and a danger to the community, turning down a spirited plea by Padilla's lawyer, Michael Caruso, to have his client released under house arrest.

Describing the case against Padilla, Caruso said, "Weak isn't even the right word."

In labeling him an "enemy combatant," the Bush administration had alleged Padilla was planning to blow up apartment buildings in the United States, as well as planning the "dirty bomb" with the al Qaeda group. The indictment against him makes no mention of those allegations.

The Supreme Court ruling did not resolve the key issue raised by the Padilla case -- whether the government has the power to order American citizens captured in the United States held indefinitely in military jails as enemy combatants.
