Federal Judge Overturns Roadless Ban

PORTLAND, OR (2003-07-14) (OPB Radio) - A federal rule that bars road building on more than a third of U.S. national forests has been thrown out by a federal judge in Wyoming. U.S. District Judge Clarence Brimmer called the rule a thinly veiled attempt to designate wilderness areas.

Earthjustice attorney Jim Angell disputes that. He says wilderness areas receive much more protection including a ban on motorized vehicles.

Jim Angell: And the roadless rule didn't afford anywhere near those sorts of protections. If there were fire projects that were absolutely in need the roadless rule didn't stand in the way of those.

An appeal is planned. Wyoming Attorney General Pat Crank says the ruling probably has implications throughout the country, including the West, where the Ninth Circuit Court of Appeals upheld the rule last winter.
