Proposal would let votes of dead absentee balloters stand in state

BATON ROUGE - It has long been thought in some parts of Louisiana that it is legal to vote from the graveyard. Now it could be statewide.

A state Senate committee approved a bill Wednesday that would let election officials count absentee ballots cast by people who die before election day.

Terrebonne Parish Registrar Linda Rodrigue said she brought the idea for Senate Bill 11 to Sen. Reggie Dupre following the death of parish President Teddy Duhe. Duhe died unexpectedly, and Rodrigue was required to nullify the absentee ballot he cast in accordance with current law.

"The current law is unfair, unenforceable and subjective," Dupre, D-Montegut, said.

Had Duhe not been a prominent local figure and elected parish official, his death could have gone unnoticed, he said.

"It's just a matter of equity," Rep. Hunt Downer, D-Houma, said. "If a person is not known, then that ballot is going to go through and that vote would be counted."

Jibing Downer for his support of the bill, Sen. Jon Johnson, D-New Orleans said, "Mr. Downer, you are running for governor. You have no intention of going through the cemetery and voting the dead?"

"No sir. You have to be alive to cast the (absentee) vote," Downer said.

He added, "If they were civic minded enough to go down and vote, it ought to count."

Despite misgivings about possible abuses, the Senate and Governmental Affairs Committee voted to send the measure to the Senate for action.
