nbc4.com Drivers Sue Over Traffic Cameras Student, Cab Company Say Cameras Are Unfair WASHINGTON -- Two D.C. attorneys are suing Mayor Tony Williams over the city's use of speed and red light cameras.
Only two plaintiffs are named in the class action lawsuit, but lawyers estimate that more than 100,000 automobile owners can join.
The suit was filed on behalf of a Howard University student who owed more than $1,500 in speeding tickets and a D.C. cab leasing company, which received at least 57 tickets and owed more than $6,500.
The attorneys said the city's automatic traffic enforcement system violates their clients' right to due process because it ultimately holds the vehicle owner responsible, rather than the driver.
Attorney Thomas Russin Jr. said his clients owned the cars caught speeding or running red lights but they weren't driving them.
"The government does not allow individuals who receive these tickets to establish their innocence. The only thing the government does is require, and I mean forcibly require, people to identify who drove the automobiles. And that violates our due process rights. The government, though this regime, does not provide trials or due process. What they do is impose a tax," Russin said.
City lawyers are hoping to dismiss the suit.
A Superior Court hearing is scheduled for Friday.
