Moussaoui's call for case to be dismissed sealed

ALEXANDRIA, Va. -- Terrorism suspect Zacarias Moussaoui wants his indictment to be dismissed, but his motion must remain secret because he used offensive language and attempted to communicate with people outside his cell, a judge said yesterday.

Moussaoui, who is serving as his own lawyer, argued that his case should be thrown out because the government defied two court orders, US District Judge Leonie Brinkema said.

The two rulings authorized Moussaoui to question three Al Qaeda prisoners who, Brinkema concluded, could testify he was not part of the Sept. 11 conspiracy as charged. The government contends the Al Qaeda loyalist has no right of access to enemy combatants held outside the United States.

A court-appointed defense team, which represents the French citizen's legal interests, already has asked Brinkema for a dismissal. Prosecutors have acknowledged that a dismissal would be the quickest way to have an appellate court decide the witness-access question. "Having reviewed the pleading, the court finds that it must remain entirely under seal because it is replete with inflammatory rhetoric, which is inappropriate for public dissemination, and further reflects an attempt by the defendant to communicate with the outside world," Brinkema wrote.
