Two Women Sue Over FBI 'No Fly' List

SAN FRANCISCO (Reuters) - Two women who publish a magazine critical of the U.S. "war on terrorism" sued the government on Tuesday saying that they and hundreds of others have been placed on an FBI "no fly" list that resulted in police detaining them for questioning at airports.

Rebecca Gordon and Jan Adams, co-publishers of War Times, were stopped at San Francisco's airport last August and detained for about 20 minutes by police before they were allowed to board their flight. Their left-wing publication takes a critical look at the U.S. "war on terrorism."

"What is disconcerting about this is the lack of any published criteria," Adams, 55, said in an interview. "It is a remarkable bureaucratic mess."

Adams said that she and Gordon, 50, were arrested several times in the 1980s for civil disobedience but did not understand why they would be on a "no fly" list today. Since the August 2002 incident they have been able to fly without incident.

ACLU JOINS SUIT

The American Civil Liberties Union, which joined the suit filed in U.S. District Court for Northern California, said that officials have stopped and questioned at least 339 other passengers at San Francisco International Airport since September 2001, when the government beefed up security after the World Trade Center attacks.

The suit, against the Federal Bureau of Investigation, Justice Department and Transportation Security Administration, seeks access to records on "no fly" lists and the payment of legal fees.

A FBI spokeswoman in San Francisco said she could not comment on pending litigation and a Justice Department spokesman declined comment because he had not seen the suit.

ACLU lawyer Jayashri Srikantiah said little was known about the "no fly" list, although it appeared all 339 passengers stopped and questioned were eventually allowed to fly.

"What we are trying to do is get information," she said. "Virtually all information about this list is based in secrecy. One of the things were are very concerned about is whether First Amendment activity is a reason for being on the list."

She said, "At the San Francisco airport alone, hundreds of passengers were stopped or questioned in connection with the so-called 'no fly' list. ... If that number is any indication, it is likely that thousands of individuals at airports across the country are being routinely detained and questioned because their names appear on a secret government list."

The ACLU said a San Francisco area computer consultant Barbara Musante and her husband, a manager with Wells Fargo Bank, were also on the San Francisco "no fly" list.

"To detain innocent people because their names are similar to someone who the FBI feels may be a danger to this country is frustrating and not acceptable," Musante said.

The mission statement of the War Times says President Bush's war on terrorism "has further endangered the lives and liberties of millions of people everywhere."

"War Times is being produced to help broaden and deepen the fight against the Bush program by compiling information and analysis," it said.
