Subject: How's It Going?
Per request from yr old friend Gorba, met w/ him in Paris on Saturday. He started w/ a long speech re how we were trying to cut him out, how important he is to the process and how he cd deliver on the hostages if only we cd sweeten the pot w/ some little tid-bits -- like more arms, etc. After his speech I allowed as he was not getting the message, but that I wd reiterate:

-- The hostages are a serious impediment to serious govt-to-govt discussions and this must be resolved before we can discuss any further transactions. -- We remain ready to go to Kish or anywhere else to discuss issues of mutual concern as long as the hostages are going to be released during or before this meeting. -- The real problem facing Iran - that of Soviet intervention was becoming a reality and the Iranians are in no position to deal w/ this problem. We can help - and are willing to because a free, independent Iran is in our best interests. Unless the hostage issue is resolved quickly and favorably, U.S./Iranian cooperation on opposing the Soviets is out of the question.

Much more said in this regard, but you have the essence. Bob Gates has assembled a nice amt of intel on the Soviet threat - most of which is real. There does indeed seem to be a growing awareness in the USSR that their Iraqi friends are having their asses handed to them and that the situation in Afghanistan is getting worse not better. Whether they are ready for another active military adventure is uncertain, but Gates now feels that four major exercises we saw last year were rehearsals for an invasion - not practice for afghanistan as we first believed. We probably won't know for a couple of weeks whether this "the Russians are coming" approach will have any effect, but it does have the merit of being mostly the truth - and something about which their military people expressed great concern during the Frankfurt meeting the week before. We shall see.

SUBJECT: Intelligence Authorization Bill
We have worked out, I believe, all the many differences which existed over the Intelligence Authorization Bill, except one which, although minor, is symptomatic of an attitude on the part of CIA which is, to a large extent, responsible for the deplorable Congressional oversight situation we find ourselves in today. The issue is a provision which has been included in the last 5 authorization bills which says, in effect, that the bill does not authorize illegal or unconstitutional acts. All (CIA, NSC, and the lawyers) are agreed that the provision, which is one of the last continuing vestiges of the Church committee mentality, has absolutely no legal purpose or effect whatsoever (e.g. by definition no bill could create authorization for an unconstitutional act - only a constitutional amendment could and then it would not be unconstitutional). Of course, no other authorization bill in the budget has such a ridiculoUS provision.

Nevertheless, CIA clings tightly to this provision, the only purpose of which is, a la Church committee, to demean intelligence by underscoring the supposition that CIA (and the Administration) are bent on illegal acts. We argued that not withstanding the fact that some in Congress- may put it in the final Bill, we should not offer it so as not to be confirming this notion which runs directly contrary to our public policy that intelligence is a good and necessary thing to protect our liberties.

CIA argues that to leave it out would be to "break faith" with the committees and bring down their rath. I say nonsense: This is why we revised the intelligence EO in 1981 to remove similar demeaning provisions. Sable and I believe that whatever happens, it will not affect Nicaragua or anything else legislatively. I say leaving this provision out will show we are serious enough about our purpose and about true congressional oversight not to put silly provisions in our bill.

I request your permission to tell John McMahon (the keeper of the CIA flame on this issue) to roll over on it and that we take it out. Small battle in a long war of small and tiring battles.

I think sending a tasking to the field is basically a non-starter. If we get it out, it will be observed in an initial flurry by posts and we will receive some material. And that will be the end of it. As the raven says: "nevermore". Better way would be to exploit one of the existing mechanisms, e.g. Publications Branch of Office of Central Reference (OCR) which constantly combs the world collecting this sort of stuff, as well as other sorts, and analyzing and categorizing it. If Gramm-Rudman's ugly head hasn't been reared here as well, it might satisfy the requirement. In any event, I would think all of this is grist [One line deleted, (b)(1)(s) exemption]

I passed the info, w/o mentioning Nir to both Clarridge and Casey. Clarridge believes that there may indeed be something to the offer fm [One line deleted, (b)(l)(3)(s) exemption] Will work w/ Dewey on a meeting plan which we may wish to carry out after we complete the hostage arrangements.

You should be aware that the resistance support organization now has more than $6M available for immediate disbursement. This reduces the need to go to third countries for help. It does not, however, reduce the urgent need to get CIA back into the management of this program. We can only do this by going forward with the reprogramming proposal and getting the requisite authorities for CIA involvement. Unless we do this, we will run increasing risks of trying to manage this program from here with the attendant physical and political liabilities. I am not complaining, and you know that I love the work, but we have to lift some of this onto the CIA so that I can get more than 2-3 hrs of sleep at night. The more money there is (and we will have a considerable amount in a few more days) the more visible the program becomes (airplanes, pilots, weapons, deliveries, etc.) and the more inquisitive will become people like Kerry, Barnes, Harkins, et al. While I care not a whit what they say about me, it could well become a political embarassment for the President and you. Much of this risk can be avoided simply by covering it with an authorized CIA program undertaken with the $15M. This is what I was about to say in the meeting today and a point that I believe Shultz does not understand in his advocacy of Third country solicitation. I have no idea what Don Regan does or does not know re my private U.S. operation but the President obviously knows why he has been meeting with several select people to thank them for their "support for Democracy" in CentAm. In short, we need to proceed with the $15M. Shall I work this up?Wrm regards, North

Case has to do with whether the Israeli reps monitoring the contract were correct in removing documents ln which tbe company asserts a proprietary interest. Case is now in civil litigation. Customs investigation should not be interpreted as implying spying- so far as I know, no one, including GOI, State and Custo ms has so asserted. In this case, State and Tel Aviv were aware of case some weeks ago. Tel Aviv 11014 relating Peres concerns to Pickering was received by NSC 8/1. State's outgoing reply - 258760 - received by NSC 8/17 - date of dispatch to Tel Aviv. Agree that Customs still is not sufficiently aware of the sensitivity involved here, but we can't assert that other agencies, including NSC did not receive. Tel Aviv 11014 was distrlbuted to JRS, DBR, PWR and SRT on 8/1 according to NSC/S records.

Casey is concerned about intelligence matters we discussed in the review session we held on the mtgs [Deleted, (b)(1)(s) exemption] George Cave reported to Casey that [Deleted, (b)(1)(s) exemption] wanted the following intelligence assistance as HIGHEST PRIORITY:. 1:50,000 scale maps, Location of Iraqi Army Corps and Division HQs 30-45km behind the front, Location of logistical centers Main Supply Routes to the front, Info on Iraqi troop movements, Reserve units and tank concentrations. Where the Iraqis believe that the main Iranian attack will occur and where diversionary attacks will occur.

[Deleted, (b)(1)(s) exemption] said that their intelligence was good from the FEEA to a depth of 30 km. They are asking for perishible info which we can tell them is likely to change every 7-10 days. We can use this info as a means of encouraging the Iranians to accept a communications team in Tehran because the info is so dynamic. We DO NOT have to tell the truth about all of this, since we know that the Iranians do not know this info. At the mtg we had w/ Case, Cave and Twetten we all agreed that this info would not change the course of the war. We need this info by the time we leave on Sunday for the Monday mtg [Deleted, (b)(1)(s) exemption]

I have seen (protect) copy of talking points prepared for the President for his meeting with the board on Monday. Two talking points give concern:
- I would like you to take particular care to look into the question of whether and under what circumstances the NSC should carry out covert operations.

- In addition, I am today ordering that no further covert operations be carried out by the NSC staff pending the outcome of the report by the Special Review Board.

The term "covert operations" is a word of art and applies to activities performed only by CIA--to acknowledge the NSC staff has done them could present real legal problems for the President. Paul Thompson and I have coined the term "secret missions" that makes the point without the legal problems--you should try and get DTR to change this. The talking points are in a meeting memo dacomed to DTR (but not to you) within the hour.

I was over at State late this morning and learned of a development about which you should be aware. My information is still sketchy -- [Deleted, (b)(6) exemption] well respected, was in Medellin, Colombia and met with top narco Mafia family members--the Ochoa brothers, Leder, etc. He returned to the US [Four lines deleted, (b)(7) exemption] Our Amb in Colombia found out about this last night and sent in a NODIS requesting that it be stopped. ARA asked Whitehead to raise with Gates at their luncheon today. Whitehead was also to speak to Meese about it. Obviously, [Two lines deleted, (b)(7)(d) exemption] if you get my drift. After internal US gov't consultations are complete, we will speak to Colombian Pres Barco about this--and are considering pre-emptive public disclosure of this development in an attempt to keep the narcos from going public with it first. I have not gotten a read out from the Whitehead Gates lunch. It's very bizarre stuff, and in light of current events, potentially damaging. Thought you should know about it.

SUBJECT: Serious Espionage Case at Embassy Moscow
[word illegible] has just informed us about a serious espionage case that occurred at [word illegible] Embassy Moscow.

[word illegible] recent days a Marine security guard assigned to American Embassy Vienna voluntarily confessed [Deleted (b)(1)(s) exemption] that while stationed at Embassy/Moscow as the result of a sexual relationship with a female Soviet FSN he had been recruited by her "uncle." The Soviets continued to meet him clandestinely in Vienna following his Moscow tour and it appears that he providedTop Secret documents, burn bags, and may have assisted the Soviets in planting audio devices within sensitive parts of the Embassy.

[One line deleted, (b)(1)(s) exemption] surveilled a meet between the Soviet and the Marine, and have been able to identify the Soviet who also may be handling another American citizen spy. No further details on this aspect.

The Marine in question is an American Indian by the name of Lonetree. He is an alcoholic and is under military arrest in London. The Navy, who has fought bitterly with the Justice Department over recent espionage cases, plans to handle the criminal aspects as a court martial.

CIA believes this to be a very serious espionage case.

Recommend you discreetly alert the President to the basic fact of -because HPSCI and SSCI are to briefed tomorrow, and they usually leak matters of this kind.

We shd get an update to day on what commitments, if any, Gates makes on notification to Congress of covert actions. This issue undoubtedly will arise in connection with SSCI retreat and Carlucci should be prepared to respond. I am not comfortable with DCI-nominee being put in position of making a unilateral commitment, as suggested by press accounts, because the issue is one of the President's prerogatives under Constitution and laws. Those prerogatives cannot and shd not be bartered by nominee
in confirmation process. If President makes such a commitment, that's another question. Do you know whether that's being contemplated in connection with Gates hearings? If so, we shd get a crack at it.
