As Primary Nears, Changes in Store in Tennessee, Virginia; What to Watch in Tuesday's Democratic Primaries

WASHINGTON, Feb. 6 /U.S. Newswire/ -- The most closely watched political contest in years takes an important turn south to Tennessee and Virginia on February 10. Primary Education: Election Reform and the 2004 Presidential Race, a publication of electionline.org and The Century Foundation, shows that while voters in both states will find elections changed since 2000, the antiquated lever and punch-card voting machines will still be in use in many polling places.

"For the first time, Tennessee will be required to offer provisional ballots. It will be critical that poll workers know how to administer provisional votes, election officials know how to count them, and most importantly, voters know what their rights are," said Dan Seligson, editor of electionline.org and a co- author of the report. "Virginia voters will be using punch cards and lever machines in a majority of counties on Tuesday. A close race could bring additional scrutiny to those voting systems, and cause some voters to wonder why, after the problems of 2000, they have not been replaced."

"Tuesday's elections will be a huge test of the states' abilities to implement the new voting rules of the Help America Vote Act, including new identification requirements, new machines, and making now maligned old machines work more effectively," said Tova Andrea Wang, senior program officer and democracy fellow of The Century Foundation, and co-author of the report. "Have we moved past Florida 2000?"

TENNESSEE

Following a federal mandate in the Help America Vote Act, Tennessee will offer voters provisional ballots for the first time. Voters who believe they are registered but whose names are not on precinct rolls will be given ballots that will be segregated and counted once the eligibility of the voter can be determined. It will also mark the first time the state has employed federally-mandated voter identification rules for first- time voters who register by mail.

Tennessee elections have also come under scrutiny in recent years because of past incidents of voter intimidation. Due to polling place problems in 2000, Tennessee will be under enhanced scrutiny by the Department of Justice on election day.

VIRGINIA

Older voting technology -- lever machines and punch cards -- will remain in use in the state for the primary and general election. That includes punch cards in six counties and lever machines in 37 counties. Electronic machines will be in use in five counties, including Fairfax, where last year candidates and officials complained after problems with new voting systems.

The state plans to dedicate more than $30 million to replace punch card and lever voting machines.

Primary Education explores the changes to voting procedures -- and potential for voting problems -- in the 22 early primary states that will be the key battlegrounds as the Democratic contenders seek to secure their party's presidential nomination. The report examines the impact of past and possible future litigation; controversies over new voting machines, electronic voting, and voter-verified audit trails; the effect of new mandates in states, including voter identification and provisional voting; and the ramifications of California's gubernatorial recall election, during which a federal court considered delaying the vote because of continued punch-card machine usage around the state. The report also offers examples of misconceptions about election reform.
