Report: Lawsuits Not the Reason for High Malpractice Costs

Washington (AP) - A new report finds lawsuits are not the reason D.C. doctors' malpractice insurance is skyrocketing.

The dollars awarded to District malpractice victims actually declined 64 percent from 2001 to 2004, according to a report on payout trends by Public Citizen. The non-profit group studied numbers from the federal government's department that tracks all malpractice claims and payouts.

Doctors are pushing the District for caps on malpractice lawsuits, saying higher insurance payouts are driving them out of business.

The director of Public Citizen's Congress Watch says the one insurance company that covers most District doctors has raised premiums an average of 15 to 20 percent a year. But Frank Clemente says the payout figures just don't match up.

A follow-up report will track insurance company profits to see if they're gouging doctors.
